Client query and legal basis
How to prove legal capacity to marry in Montenegro when Slovakia no longer issues certificates of legal capacity since February 1, 2006?
Montenegrin civil registry offices (Matični ured), when processing a marriage application, require proof of civil status and legal capacity to marry. Since the Slovak Republic does not issue state certificates, Montenegrin authorities exclusively accept a notary-certified affidavit with an international Apostille certificate under the Hague Convention and a sworn court translation into Montenegrin.
Step-by-step procedure: How to resolve the matter safely
1. Filling in the bilingual affidavit template (ME / SK) (Legalization Center Bratislava)
Prepare a monolingual or bilingual wording of the affidavit in Montenegrin and/or Slovak. You can customize the text freely according to your needs. If the wording is in Slovak, after obtaining the Apostille we will officially translate the entire document into Montenegrin.
2. Signature certification before a Slovak notary (Notary office in Slovakia)
The declarant personally signs the document before a Slovak notary (or candidate notary). The signature must not be certified by an employee authorized by a notary, by a notary trainee, nor certified at a municipal office.
3. Issuance of the Apostille certificate (Legalization Center Bratislava)
The Legalization Center will secure the international Apostille certificate according to the Hague Convention.
4. Official sworn translation of clauses and tricolor binding (Sworn court translator registered with the Ministry of Justice of the Slovak Republic)
We will arrange the official translation of the document. A sworn court translator will prepare an official translation of the Slovak notarial and Apostille clauses (and if needed, the entire document) into Montenegrin and firmly bind the document with a tricolor ribbon and round seal.
